M&S Meats Affiliate Program Policy & Terms

This Affiliate Program Policy ("Policy") governs participation in the M&S Meats Affiliate Program (the "Program"), operated through Refersion in connection with our Shopify store www.msmeats.com. By applying to and/or participating in the Program, you ("Affiliate," "you") agree to these terms.

1. Eligibility & Application

Affiliates must be at least 18 years old and a legal resident of the United States.

All applications are reviewed manually before approval. M&S Meats reserves the right to approve or reject any application at its sole discretion, without obligation to explain the decision.

Approved affiliates receive a unique tracking link and/or discount code via Refersion.

We reserve the right to remove or reject affiliates who do not align with brand values, or whose content/channels are inappropriate, illegal, or damaging to brand reputation.

2. Commission Structure

Standard commission rate: 10% of net sale value (excluding taxes, shipping, and discounts) per qualifying order.

Tiered/bonus rates (if applicable): [e.g., higher % after $Y in monthly tracked sales — leave blank if flat-rate only].

Commissions are calculated on the net order amount after returns, refunds, and cancellations — commission is reversed if the underlying order is refunded or charged back.

M&S Meats reserves the right to change commission rates with [30] days' notice to active affiliates.

3. Cookie Window & Attribution

Tracking cookie duration: as configured in the M&S Meats Refersion program settings (see current program details in the Refersion affiliate dashboard for the exact number of days).

Attribution follows last-click methodology unless otherwise stated.

If an affiliate-referred customer completes a purchase within the cookie window, the sale is attributed to that affiliate even if the customer later clicks through another channel — except paid search/branded PPC, which always overrides per Section 5.

4. Approved Promotional Channels

Affiliates may promote M&S Meats through:

- Original blog/website content, product reviews, and buying guides

- Organic social media (Instagram, TikTok, YouTube, Pinterest, etc.)

- Email newsletters to an owned list (no purchased/rented lists)

- Podcasts and video content with proper disclosure

5. Prohibited Practices

The following are strictly prohibited and will result in commission forfeiture and/or termination:

Brand-term PPC/SEM bidding — bidding on "M&S Meats," misspellings, or branded keyword variants in Google/Bing/Meta paid search or paid social.

Cookie stuffing, forced clicks, or auto-redirects — any technique that drops a tracking cookie without a genuine, informed user click.

Incentivized or fraudulent traffic — paying users to click, "cashback for clicking" schemes not pre-approved, bot traffic, or click farms.

Coupon and deal sites — zero tolerance. M&S Meats discount codes may not appear on any coupon, deal, or cashback aggregator site (e.g., RetailMeNot, Honey, CouponFollow, and similar), whether submitted by the affiliate or scraped/listed by the site itself. Affiliates are responsible for monitoring and requesting removal of any of their codes that appear on such sites. Use of a code sourced from a coupon site by a customer — regardless of who listed it — does not qualify for commission, and repeated appearances tied to a given affiliate's code may result in that code being deactivated.

Trademark/domain infringement — using "M&S Meats" or confusingly similar terms in domain names, page titles, or ad copy without permission.

False, misleading, or unsubstantiated claims — no health, medical, or performance claims beyond what M&S Meats has approved in official marketing copy.

Spam — unsolicited email, SMS, comment spam, or social DM spam referencing M&S Meats.

Violation of this section may result in immediate termination and forfeiture of unpaid commissions.

6. FTC Disclosure Requirements (Required — U.S. Law)

All U.S. affiliates must comply with the FTC's Endorsement Guides and Disclosures 101 guidance:

Disclose the material connection to M&S Meats clearly and conspicuously, in every post, video, or piece of content that includes an affiliate link or code — not buried in a bio, "show more" section, or link-in-bio page alone.

Disclosure must appear before the affiliate link/CTA and use unambiguous language: e.g., "#ad," "#MSMeatsPartner," or "This post contains affiliate links — I earn a commission on purchases at no extra cost to you."

On video/audio content, disclosure must be both verbal (or on-screen text held long enough to read) and in the written description.

Affiliates are personally responsible for their own FTC compliance; M&S Meats is not liable for an affiliate's failure to disclose, but non-compliant affiliates may be suspended pending correction.

7. Brand & Creative Usage

Affiliates may use M&S Meats-provided product images, logos, and approved copy solely to promote M&S Meats products.

No modification of the logo, no use in a way that implies co-ownership or an exclusive partnership, and no use on content that is illegal, adult, hateful, or otherwise damaging to brand reputation.

Any custom creative (photos/video featuring products) must be pre-approved before paid use.

8. Payment Terms

Payments are processed through Refersion on a [monthly, Net 30] basis.

Minimum payout threshold: $[50]. Balances below this roll over to the next period.

Affiliates are responsible for their own tax reporting; M&S Meats will issue a Form 1099-NEC to any U.S. affiliate earning $600 or more in a calendar year, per IRS requirements. Affiliates must provide a completed W-9 before payment.

M&S Meats is not responsible for payments lost due to incorrect payment details provided by the affiliate.

9. Term & Termination

Either party may terminate participation at any time, for any reason, with [written notice / immediate effect].

M&S Meats reserves the right to withhold or claw back commissions tied to fraudulent, prohibited, or policy-violating activity, even after payment.

Upon termination, the affiliate must immediately cease all use of M&S Meats trademarks, links, and marketing materials.

10. Program Changes

M&S Meats may update this Policy, commission rates, or program terms at any time. Material changes will be communicated to active affiliates via email or the Refersion dashboard; continued participation after changes take effect constitutes acceptance.

11. Limitation of Liability

The Program is provided "as is." M&S Meats makes no guarantee of a minimum number of clicks, conversions, or earnings. M&S Meats's liability under this Program is limited to unpaid, valid commissions owed at the time of any dispute.

M&S Meats Affiliate Program Privacy Policy

This Privacy Policy explains what personal data M&S Meats collects from affiliates participating in the M&S Meats Affiliate Program (the "Program"), why we collect it, who we share it with, and the rights affiliates have over it. This policy covers affiliates, not end customers — customer data is covered separately under the main M&S Meats site Privacy Policy at https://msmeats.com/policies/privacy-policy

1. Who This Applies To

Any individual or business that applies to, is approved for, or participates in the M&S Meats Affiliate Program, operated through Refersion in connection with the M&S Meats Shopify store.

2. Information We Collect

Provided directly by you (the affiliate):

Name, email address, and (where applicable) business/company name

Payment details for commission payout (e.g., PayPal email, bank details as required by Refersion's payout method)

Tax information required for U.S. reporting — completed Form W-9, and Taxpayer ID/SSN or EIN where earnings meet IRS 1099-NEC thresholds

Website, social media handles, and audience/channel details submitted during application

Any content you submit for review (creative assets, links to your posts)

Collected automatically through tracking (via Refersion):

Click and referral tracking data tied to your unique affiliate link/code (timestamp, referring URL, order attribution)

Cookie/device data associated with the attribution window described in our Affiliate Program Policy — this is used to attribute sales to the correct affiliate, not to build a profile of your personal browsing

Performance data: clicks, conversions, commission earned, payout history

3. How We Use This Information

To evaluate and approve/reject Program applications

To track referred sales and calculate, process, and report on commissions

To pay affiliates and meet U.S. tax reporting obligations (issuing Form 1099-NEC where required)

To communicate Program updates, policy changes, and payment confirmations

To detect and prevent fraud, cookie stuffing, or violations of the Affiliate Program Policy

To monitor for prohibited use of discount codes (e.g., appearing on coupon/deal sites)

We do not use affiliate personal data for purposes unrelated to operating the Program.

4. Who We Share It With

Refersion — our affiliate tracking and payout platform, which processes affiliate data on our behalf as a service provider. Refersion has its own privacy practices governing data on its platform (Refersion Privacy Policy).

Payment processors — to the extent needed to issue commission payments (e.g., PayPal).

Legal/regulatory authorities — where required by law (e.g., IRS tax reporting).

We do not sell affiliate personal information to third parties, and we do not share it with other affiliates or unrelated third parties for their own marketing purposes.

5. Data Retention

We retain affiliate account and transaction data for as long as the affiliate relationship is active, and for a minimum of [7 years] afterward to satisfy U.S. tax record-keeping requirements. Marketing/communication data is retained only as long as needed for Program administration.

6. Your Rights (California Residents / CCPA)

If you are a California resident, you have the right to:

Know what personal information we've collected about you and why

Request deletion of your personal information (subject to legal retention requirements, such as tax records)

Correct inaccurate personal information

Opt out of the sale or sharing of personal information — note: M&S Meats does not sell or share affiliate personal information, so there is nothing to opt out of

Not be discriminated against for exercising these rights

7. Data Security

We rely on Refersion's platform security controls for tracking and payout data, and limit internal access to affiliate personal data to team members who need it to operate the Program. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Cookies & Tracking Disclosure

Participation in the Program relies on tracking cookies placed by Refersion when a customer clicks your affiliate link, used solely to attribute the resulting sale to your account. This is separate from any cookies M&S Meats uses on-site for its own analytics/advertising, which are disclosed in the main site Privacy Policy.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated to active affiliates via email or the Refersion dashboard. Continued participation in the Program after changes take effect constitutes acceptance.
